Burger King has settled in court with a truck driver for a spitting incident that occurred in 2008 at a roadside restaurant in northwestern Pennsylvania.
Glenn Goodwin, of Cleveland, according to ABC News, filed a civil rights lawsuit against Fast Food Enterprises that runs the Burger King on Interstate 90 in Fairview.
Goodwin, a black trucker, made a stop at the fast food chain and ordered a Whopper Jr., Goodwin claimed that a Burger King employee spat on his burger and he quickly discarded of the item.
The Erie Times-News first reported the settlement on Friday. Attorneys for both sides declined to comment, citing a confidentiality agreement.
Defense attorneys argued there's no proof of the spitting or that the worker was motivated by racial prejudice if it occurred.
According to ABC, a federal judge refused to dismiss the lawsuit last year. State police found saliva in the burger but didn't charge anyone because it was thrown away without a DNA test.
Bad fast food practices is nothing new to the industry. Various chains have been accused of similar incidents. Recently, a Golden Corral got 167 people sick in Wyoming prompting damning attacks from victims.
Yahoo reported earlier in the year that a McDonald's employee spat it two customers iced teas. The two complained that tea was not sweet enough.
A video shows an employee, 19-year-old Marvin Washington Jr., leaning over the open cups before giving them back. The fast food chain patrons claim they discovered phlegm in the drinks when they removed their tops. He was arrested and charged with malicious tampering with food.
